All services provided by National IT Solutions Limited ("nationalitbd.com") may only be used for lawful purposes.

The transmission, storage or presentation of any information, data or material that violates the laws of any state or city is prohibited. This includes, but is not limited to, copyrighted material, material that we consider to be threatening or obscene, or material protected by trade secrets and other laws. Customer agrees to indemnify and hold National IT Solutions Limited harmless from any claims arising out of the use of the Services that cause harm to Customer or any other party. Prohibited Sites: Any sites that promote illegal activities or present material that may harm National IT Solutions Limited's servers or any other server on the Internet. Links to such materials are also prohibited.

 

Unacceptable content or links:

• Pirated software

• Hacker programs or archives

• Warez site hosting or linking

• Audio or video streaming (not applicable for VPS)

• Social networking sites (not applicable for VPS)

• Phishing sites

• Investment sites (Forex, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid schemes)

• Fraudulent sites, Spam websites, Spamming emails/Mass emails, Email marketing, Gambling websites

• Arcade/Online gaming websites, Null scripts

• Image hosting scripts (similar to Photobucket or TinyPic)

• File hosting sites (not applicable for VPS)

• File hosting/Backup hosting (not applicable for VPS)

• Proxy sites/IRC/Lottery/Gambling sites

• Viruses/Malware/Spyware

• Adult sites, Illegal/Child pornography

• About terrorism Sites posting materials or reposting articles from wikileaks.org

• Torrentflux or similar, Rapidshare link generator, Rapidleech or similar

• PHPizabi and YaBB forums or any forum that uses flat files as a database

• Outdated scripts or software

• Any scripts that damage the server, such as some WordPress plugins

• Scripts that use more than 20% of the server resources (not applicable to VPS)

 

Notice:

 

If your account is found to contain illegal activity, illegal MP3 files, pirated software, phishing sites, hacker programs, WAREZ programs, or any other illegal files, your account will be terminated immediately, without notice, and a $100 termination fee will apply. Additionally, National IT Solutions Ltd. will notify the appropriate authorities of your actions.

 

Overselling / Fair Use

You should not unnecessarily create accounts, install scripts/software, or upload any files that increase space usage if you have no intention of using them. As part of our fair usage policy, excessive CPU usage is not permitted. You may not start the following on our shared hosting servers (excluding VPS and dedicated servers):

• Run any type of interactive real-time chat application that requires server resources. Remotely-hosted services are fully permitted.

• Run independent, redundant server-side processes on the server at any time.

• Run any type of web spider or indexer (including Google Cache / Adspy) on shared servers.

• Run cron entries at intervals of less than 15 minutes.

 

Run download sites.

• The cPanel backup file has been disabled because customers are abusing it by creating 10 or more backups at once or running an automatic backup every 5 minutes. This is not allowed. However, you can request that we set up an account for you and we will happily do so.

 

• Customers may not use disk space as a file repository or dump site. This includes but is not limited to: warez, serials, sound files (mp3/wav), applications, zip/rar/iso files. Your account will be used to host a website, not for file storage.

 

Termination

National IT Solutions Limited may terminate your service in the following circumstances: non-payment of fees; you are in breach of any term of this Agreement; your use of the service disrupts the business operations of National IT Solutions Limited or affects any other party.

 

Termination Date: 7 days after the due date of payment, account termination.

 

Backup Limitations

Backups from National IT Solutions Limited are provided as a courtesy and are not guaranteed. Customers are responsible for their own backups and web content and should take backups for additional protection. This service is provided as a courtesy to shared and reseller accounts only and may be changed or terminated at any time at the sole discretion of National IT Solutions Limited. Backups are kept for a maximum of 7 days. We keep backups of up to 2 GB of your cPanel. If you wish to increase this, you will need to purchase additional space or use a third-party backup service. Therefore, we recommend that you keep the size of your cPanel account below 2 GB.

File Usage and Storage

 

Hosting accounts may not be used to distribute and/or store an unusual number of files. We are a web hosting service, not a remote file storage service. Any website that uses disk space for storing files that exceeds 50% of its total usage, in terms of total size or number of files, will be deemed to be using an abnormal number of files. At that time, if we find that those files are in any way illegal or harmful, we will suspend or terminate you with or without prior notice, depending on the severity of the damage.

 

Unmetered Space and Bandwidth

Nothing in this world is unlimited, and that includes server space and bandwidth. At National IT Solutions Limited, we do not keep track of how much space you are using. Clients can use the servers as long as they do not overload the servers with the amount of space, bandwidth, accounts, and server resources they are using. Normally, with unmetered space and bandwidth, you can use it without facing any problems, but if your website overloads the servers, National IT Solutions Limited reserves the right to suspend or terminate your site with a predetermined amount of traffic allowance.

 

Traffic Usage: All account plans have a predetermined amount of traffic allowance. We monitor all accounts and charge $1.00 for each gig of traffic that is exceeded. This amount is not prorated, meaning that 1 MB - 1 Gig will be considered and billed the same.

 

IRC: We do not currently allow IRC or IRC bots to operate on our servers.

 

Server Abuse

Any attempt to undermine or harm any server or customer of National IT Solutions Limited is strictly prohibited. As our customer, you are responsible for all your accounts. If you violate the Terms of Service, your account will be terminated without a refund.

 

Refusal of Service: We reserve the right to refuse, terminate or suspend service at our sole discretion.

 

All sub-networks, distribution hosting sites and dedicated servers of National IT Solutions Limited must comply with the above policies, except for system resources related to the dedicated server.

 

Billing: By the Account Activation Date of each month, National IT Solutions Limited will:

 

(1) debit the Client’s credit card (when such information is provided by the Client); or

 

(2) Provide an invoice by e-mail or regular mail for the applicable Service Fees for the Services provided for the current month. When an invoice is provided to the Client, payment shall be made to National IT Solutions Limited by the specified payment date. National IT Solutions Limited shall be entitled to immediately terminate this Agreement for failure to make timely payment. You will be provided with an invoice each month. All credit cards are automatically billed each month. It is the Client’s responsibility to ensure that they have sufficient credit to cover this transaction. If there is insufficient credit, we will send an e-mail notification, after which we must provide another credit card account number within 24 hours. If we do not receive a response within 24 hours, the account and all accounts under that account plan will be suspended.

 

Service Fees

Some services are charged by National IT Solutions Limited to the Client for a setup fee, which the Client must pay to use the said services. If the Client terminates this Agreement, any fees owed to National IT Solutions Limited will be borne by the Client and the Client agrees to pay any fees.

 

Since the Services are provided monthly, the applicable service fees for each month will be borne by the Client, regardless of when the Client provides notice of termination. For example, if the Client provides notice of termination on the 15th of a particular month, the Client will be liable to pay the service fees for the entire month and such fees will not be refunded on a prorated basis.

 

Refunds:

Ø  Domain registration and web hosting fees are non-refundable

Ø  Domain transfer fee Rs. 3,000/-

Ø  Website, software, app and web application development fees are non-refundable.

 

If the Client has purchased Services for one year and requests other such Services or changes packages/services, the new package/service will still be effective as of the new date. No refunds will be given for any unused full months of the remaining months of the previous package/service.

 

If the Client’s account is cancelled within one year, upon notice given by the 25th of the previous month, the Client will not be entitled to a refund for the remaining months.

 

Account Deactivation

Any account deactivated for non-payment will be subject to a $20.00 reactivation fee before reactivation.

 

Cancellation Refunds

We do not refund partial monthly fees on accounts. We require 30 days' notice for cancellations.

 

Service Denial

We reserve the right to refuse, cancel or suspend service at our sole discretion.

 

Limitation of Liability

National IT Solutions Limited shall not be liable for any claimed damages, including incidental and consequential damages, arising from National IT Solutions Limited's servers going off-line or being unavailable for any reason. Furthermore, National IT Solutions Limited shall not be liable for any claimed damages, including incidental or consequential damages, arising from the corruption or deletion of any website from National IT Solutions Limited's servers. All damages shall be limited to the immediate termination of service.

 

Violations

Violations of this Acceptable Use Policy should be reported to info@nationalitbd.com. All complaints will be promptly investigated. Failure to comply with any of the terms and conditions will result in immediate account deactivation.

 

Disclaimer

National IT Solutions Limited cannot be held responsible for system downtime, crashes or data loss. We cannot be held responsible for any predicted estimates of the profits that a client would have made if their site had been operational. Some of the services provided by National IT Solutions Limited are resold. Therefore, some of the equipment, routing, software and programming used by National IT Solutions Limited are not directly owned or written by National IT Solutions Limited.

 

Furthermore, National IT Solutions Limited assumes no liability for the use of our clients’ accounts. Failure to comply with any of the terms and conditions will automatically result in the account in question being deactivated. We reserve the right to remove any account for any reason without notice, as National IT Solutions Limited deems fit.

 

Account Activation

By activating your account with National IT Solutions Limited, you agree to the above policies and disclaimers. When requesting to activate an account, you will be required to accept these policies, guidelines and disclaimers and a copy of your account acknowledgment along with your account information will be sent with your activation request.

 

Notice: If you sign up for an account and fail to comply with these terms, no refund will be given. However, we will advise you via email before taking any action to provide you with an opportunity to resolve the issue.

 

Server Uptime Guarantee

National IT Solutions Limited guarantees 99.9% service (http, ftp, pop, imap, smtp) uptime on all hosting plans.

 

National IT Solutions Limited reserves the right to amend any or all of the above policies, guidelines and disclaimers without notice. We also reserve the right to increase or change any prices in our account plans without notice.
